These Terms and Conditions (“Terms”) govern your use of the services provided by Smith Bros Lawn Care (“Company”, “we”, “us”, or “our”), located in Stratford, Prince Edward Island, Canada, and the use of our website at smithbroslawncare.ca. By booking our services or using our website, you agree to be bound by these Terms.
Smith Bros Lawn Care provides residential and commercial lawn care, landscaping, and outdoor improvement services throughout Charlottetown and surrounding areas in Prince Edward Island. The specific scope of services for each engagement will be outlined in a written quote provided to you prior to commencement of work.
All quotes are provided following an in-person property assessment and are valid for 30 days from the date of issuance. Prices are subject to change after the quote validity period expires. Final pricing may be adjusted if unforeseen site conditions, scope changes, or additional materials are required. We will communicate any changes and obtain your approval before proceeding.
Services are booked upon your written or verbal acceptance of a quote. We will make reasonable efforts to complete services within the agreed timeframe. Scheduling is subject to weather conditions, equipment availability, and other factors beyond our control. We reserve the right to reschedule services and will notify you as promptly as possible of any changes.
Payment is due upon completion of services unless otherwise agreed in writing. For larger projects, we may require a deposit prior to commencement. Accepted payment methods will be communicated at the time of booking. Invoices not paid within 30 days of the due date may be subject to a late payment fee of 1.5% per month on the outstanding balance.
You may cancel or reschedule a scheduled service by providing at least 48 hours’ advance notice. Cancellations made with less than 48 hours’ notice may be subject to a cancellation fee equivalent to 25% of the quoted service cost. Deposits for larger projects may be non-refundable depending on the work already performed or materials ordered.
To allow us to perform services safely and effectively, you agree to:
• Ensure clear access to the work area on the scheduled service date.
• Remove or secure pets, vehicles, and personal belongings from the work area.
• Inform us of any underground utilities, irrigation systems, or other hazards on your property.
• Ensure any required permits are obtained prior to commencement of work, unless otherwise agreed.
Smith Bros Lawn Care stands behind the quality of its work. If you are unsatisfied with any aspect of our services, please contact us within 5 business days of service completion. We will work with you to address any legitimate concerns at no additional cost. This commitment does not cover issues arising from events outside our control, client misuse, or normal wear following completion.
To the fullest extent permitted by applicable law, Smith Bros Lawn Care shall not be liable for any indirect, incidental, special, or consequential damages arising from the provision of services. Our total liability for any claim arising from our services shall not exceed the amount paid by you for the specific service giving rise to the claim.
We carry liability insurance and will handle any claims for property damage caused directly by our negligence in a fair and timely manner. We are not liable for pre-existing conditions, hidden underground obstacles not disclosed to us, or damage caused by events beyond our control such as severe weather.
These Terms are governed by the laws of the Province of Prince Edward Island and the federal laws of Canada applicable therein. Any disputes shall be resolved in the courts of Prince Edward Island.
We reserve the right to update these Terms at any time. Changes will be posted on our website with a revised effective date. Your continued use of our services after such changes constitutes your acceptance of the updated Terms.
